Presented at the ESHRE meeting in London<\/a> on July 8, the proposal responds to a fragmented regulatory landscape in which donor limits vary wildly across Europe\u2014and are often unenforceable when gametes cross borders.<\/p>\n

Why National Donor Limits Are Failing<\/h2>\n

Several European countries already impose legal caps on how many children a single donor can help create. In Malta and Cyprus, both egg and sperm donors are restricted to contributing to the birth of just one child. The United Kingdom sets a limit of 10 families per donor, while Denmark caps donations at 12 families. These limits are designed to prevent the unintended creation of large, geographically dispersed half-sibling networks and to reduce the psychological and social risks for donor-conceived individuals.<\/p>\n

But enforcement breaks down when donations cross national borders. Denmark, a major exporter of sperm, supplies clinics across Europe. In 2020, more than half of all sperm donations used in the UK were imported\u2014most originating from either Denmark or the US. A donor who complies with Denmark’s 12-family rule domestically could, in practice, contribute to dozens more families abroad, bypassing the intent of every country’s regulation.<\/p>\n

\u201cThe only thing that really makes sense is a transnational limit,\u201d said Jackson Kirkman-Brown, a professor of reproductive biology at the University of Birmingham, during the ESHRE meeting.<\/p>\n

ESHRE’s Proposed 50-Family Limit<\/h2>\n

Kirkman-Brown and his colleagues have spent months developing a formal position paper, published in the journal Human Reproduction<\/em>, that outlines ESHRE’s stance on donation limits. After consulting fertility specialists, clinics, sperm and egg banks, donors, and donor-conceived individuals, the working group settled on an initial Europe-wide cap of 50 families per donor.<\/p>\n

Fifty is a deliberately high starting point\u2014acknowledged by the team as likely too high\u2014but it represents a pragmatic first step toward harmonization across a continent where no transnational framework currently exists. ESHRE is calling on sperm and egg banks and fertility clinics to voluntarily adopt the limit as a shared standard.<\/p>\n

The Long-Term Goal: 15 Families and Beyond<\/h2>\n

The organization’s longer-term target is more restrictive. Kirkman-Brown stated that Europe should move toward a limit of 15 families per donor. Even that figure may prove too high. Vasanti Jadva, who studies the psychological well-being of donor-conceived individuals at City St George\u2019s in London, noted, \u201cWe still don\u2019t know what the right number is.\u201d The same uncertainty applies to the social and emotional outcomes for children who may discover dozens of genetic half-siblings through direct-to-consumer DNA testing and donor registries.<\/p>\n

What is the current donor family limit in the UK? The UK’s Human Fertilisation and Embryology Authority (HFEA) sets a limit of 10 families per donor, which is among the more restrictive in Europe. However, this limit applies only to UK-registered clinics and does not account for imported gametes from countries with higher or unenforced caps.<\/p>\n

What This Means for Fertility Clinics and Patients<\/h2>\n

ESHRE’s proposal is voluntary, not legally binding. Its effectiveness will depend on whether major gamete banks and fertility clinics across Europe choose to comply. If Denmark’s largest sperm banks, for example, adopt the 50-family cap, the impact on cross-border donation patterns could be significant. For patients, the shift may mean reduced access to certain donor profiles in the short term, but it also promises greater transparency about the genetic networks their future children may be part of.<\/p>\n

Clinics that rely heavily on imported donor material will need to verify the origin and cumulative family count of each donor across multiple jurisdictions\u2014a logistical challenge that will require standardized data sharing across borders. ESHRE’s position paper is intended to provide the technical and ethical framework for that coordination.<\/p>\n

Who Should Pay Attention to This Development<\/h2>\n

Fertility clinicians, gamete bank operators, and regulators in Europe should evaluate how the proposed 50-family limit interacts with existing national laws and whether their supply chains can accommodate the new standard. Donor-conceived individuals and parents considering donor gametes now have a stronger basis for asking clinics about the total number of families linked to a specific donor\u2014across all countries, not just the clinic’s home market. The practical takeaway is straightforward: any clinic or bank that claims to manage donor limits transparently should be able to disclose the cumulative family count across every jurisdiction where its donors have been used.
