ChatGPTが、有名作家のスタイルを直接模倣する要求を拒否するようになった。

Ars Technicaが報じたテストでは、スティーヴン・キング風の書き出しを求めるプロンプトに対し、ChatGPTは「キングの正確なスタイルや独特の声は再現できない」と返答したという。心理描写を軸にしたホラーや田舎町の不安感といった特徴なら使えるが、特定の作家の「声」には踏み込まない。J・K・ローリング、エイミ・タンといった存命作家でも、チャールズ・ディケンズやヘミングウェイといった故人でも同じ反応が確認された。

ただし故人作家については、条件次第で応じるケースもある。7月に公開されたNo Latencyの比較調査では、ChatGPTは存命作家のスタイル模倣を拒否した一方、故人作家には応じている。

拒否する場合でも、代替案は出す。作風に通じる要素（緊張感、語りの速度、視点の置き方など）を取り入れた文章を「雰囲気」として提案し、特定の作家の表現そのものは再現しない。

OpenAIの広報担当者はコメント要請に応じていない。

「スタイル」と「雰囲気」の法的な距離

一見すると言葉遊びに見えるこの区別が、法廷では重い意味を帯びる。

米国の著作権法が保護するのは、アイデアの「特定の表現」だ。作家のスタイルそのものは表現よりも抽象度が高く、原則として保護の対象にならない。AI生成のスタイル模倣が著作権侵害になりうるのは、出力が原著者の作品と「実質的に類似（substantially similar）」と判断された場合に限られる。

OpenAIは現在、書籍の著者が起こした複数の著作権侵害訴訟を抱えている。ニューヨーク南部地区連邦地裁では十数件がまとめて審理されており、訴訟の1つはChatGPTが著作権で保護されたテキストに酷似した文章を生成する能力を争点にしている。

AI企業とクリエイターの間の著作権紛争は、先週にも大きな動きがあった。7月20日、AnthropicがBartz v. Anthropic訴訟で合意した15億ドル（約2,400億円）の和解に最終承認が下りている。この訴訟では、AI学習に書籍を使うこと自体はフェアユースと認められたが、海賊版サイトからの書籍ダウンロードは違法と判断された。

ChatGPTの動作変更は、こうした訴訟リスクの中で読む必要がある。「スタイルの模倣」を拒否し「雰囲気の再現」に留めれば、出力が原著作物と「実質的に類似」する余地は狭まる。

全米作家協会（Authors Guild）も指針の中で、他の作家の独自のスタイルや声を意図的に模倣するためにAIを使わないよう会員に求めている。不正競争や著作権侵害の請求につながりかねないとの認識からだ。

5社5様の対応

この問題に対するLLM各社の対応は統一されていない。

No Latencyが2026年7月にChatGPT、Claude、Gemini、Copilot、Perplexityの5つを対象に実施した比較調査は、存命作家のスタイル模倣に対する反応を3つのパターンに分類した。

拒否して代替案を示すのがChatGPTとPerplexity AI。AnthropicのClaudeとMicrosoftのCopilotは要求に応じつつ、独自性への留意を促す注釈を添えた。GoogleのGeminiは注釈なしに直接応じており、テストで最も寛容な対応を見せている。

存命と故人で扱いが分かれた点も目を引く。ChatGPTは故人作家には模倣に応じたが、Perplexityは故人作家も拒否した。Perplexityの境界線は、作家の生死ではなく「正確なスタイル再現」そのものにある。一方、ゴシック調やノワール調といった特定の作家名を含まない広範な文体については、5社すべてが制限なく応じている。

OpenAIは画像生成モデルDALL·E 3について、存命アーティストのスタイルを模倣する要求を拒否すると明言している。テキスト出力には同様の制限がなく、公開されているモデルスペックにも著作権素材の複製やスタイル模倣を明示的に禁じる条項は見当たらない。ポリシーを正式に更新した結果なのか、モデルの調整で変わっただけなのかも不明のままだ。

本に残されたAIの指示書き

スタイル模倣をめぐるトラブルは、ChatGPTの動作変更より前に起きている。

2025年5月、著者リーナ・マクドナルド（Lena McDonald）のファンタジー小説『Darkhollow Academy: Year 2』から、AIの編集指示がそのまま残った箇所が見つかった。ロマンスファンタジーの人気作家J・ブリー（J. Bree）のスタイルに合わせて書き直したと記された一文が、第3章に残されていたという。Amazonでは当該部分が修正されたが、スクリーンショットが拡散し、読者からの批判が相次いだ。

LLMの模倣能力を学術的に検証する動きもある。2026年6月には、オーストラリア国立大学の研究者がChatGPTの文体模倣能力を法的鑑定の手法で分析した論文をOxford Academic誌に発表している。

ChatGPTが引いた「スタイルは模倣しないが雰囲気は再現する」という線は、著作権法上は理にかなっている。ただ、その雰囲気がどこまで原著に近づけば「実質的に類似」になるのかを定めた基準は、どの国の法廷にもまだない。
